Terms and Conditions
1. Introduction
Welcome to Jain Voyagers Inc. These terms and conditions govern your use of our website and services, including bookings, travel arrangements, and other services we provide. By using our services, you agree to comply with these terms. Please read them carefully before proceeding.
2. Booking and Payment Terms
2.1 Booking Confirmation
A deposit (as communicated) must be paid at the time of booking.
Full payment must be made within the timeframe mentioned in your booking confirmation or as agreed.
2.2 Pricing
All prices are subject to availability and may change without prior notice. Once a booking is confirmed, the price will be fixed unless changes are made.
Prices are inclusive of applicable Canadian taxes unless stated otherwise.
2.3 Payment Methods
Payments can be made via bank transfer, debit/credit card, or any other method accepted by Jain Voyagers Inc.
All payments must be in CAD unless otherwise agreed.
2.4 Late Payment
Failure to pay on time may result in cancellation of your booking, and the deposit may be forfeited.
You are responsible for any additional charges related to late payments.
3. Cancellation and Refund Policy
3.1 Cancellations by the Customer
If you need to cancel your booking, you must notify us in writing. Cancellation charges will apply as follows:
Up to 60 days before departure: 30% of total cost.
59-30 days before departure: 60% of total cost.
Less than 30 days before departure: 100% of total cost.
3.2 Cancellations by Us
Jain Voyagers Inc. reserves the right to cancel a booking due to unforeseen circumstances. In such cases, you will be offered alternative travel arrangements or a full refund.
3.3 Refunds
Refunds will be processed within 60 to 90 days of receiving a cancellation request.
Refunds will be issued through the original payment method.
4. Amendments to Bookings
Any amendments to a confirmed booking must be requested in writing and may incur additional charges.
Jain Voyagers Inc. reserves the right to deny amendments that may impact service quality or availability.
5. Your Responsibilities
5.1 Travel Documents
It is your responsibility to ensure that all necessary travel documents, including passports, visas, and health certificates, are valid and up-to-date.
Jain Voyagers Inc. is not liable for any costs or cancellations due to failure to secure appropriate documents.
5.2 Insurance
We strongly recommend that all customers obtain comprehensive travel insurance.
Jain Voyagers Inc. is not responsible for losses or damages not covered by your insurance policy.
5.3 Conduct
You agree to behave responsibly and respectfully during the tour.
We reserve the right to refuse service or terminate a booking if conduct is deemed inappropriate.
No refunds will be provided in such cases.
6. Our Responsibilities
6.1 Service Provision
Jain Voyagers Inc. is responsible for ensuring that travel arrangements are provided as per the itinerary and booking confirmation.
Unforeseen circumstances such as natural disasters, strikes, or government actions may affect service provision. We will endeavor to minimize disruptions and offer alternatives where possible.
6.2 Third-Party Suppliers
Some services (such as hotels, transport, and tours) are supplied by independent third parties.
Jain Voyagers Inc. acts as an intermediary and is not responsible for service deficiencies caused by third parties.
7. Limitation of Liability
Jain Voyagers Inc. will not be held liable for:
Any loss or damage to personal property during the trip.
Any injury, illness, or death resulting from activities not explicitly part of our service.
Additional costs due to delays, changes, or cancellations beyond our control (e.g., flight cancellations, natural disasters, etc.).
Our liability is limited to the cost of the booking, and we will not be liable for consequential losses or additional costs.
8. Force Majeure
Jain Voyagers Inc. will not be liable for failure to perform obligations due to causes beyond reasonable control, including but not limited to natural disasters, war, government restrictions, and strikes.
9. Complaints Procedure
If you have any complaints during your trip, inform us or the local service provider immediately.
If unresolved, submit a formal written complaint within 14 days after the trip to grievances@jainvoyagers.ca.
We will review and respond within 28 days.
10. Privacy and Data Protection
Your privacy is important to us. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA).
Refer to our Privacy Policy for details on data collection, storage, and usage.
11. Changes to Terms and Conditions
Jain Voyagers Inc. reserves the right to update these terms without prior notice.
Changes take effect immediately upon posting on our website. Continued use of our services constitutes acceptance of revised terms.
12. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of Canada.
Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
